PREAMBLE
The General Terms set out herein are applicable to legal operations in connection with products commercialized by MARIE-SABOTINE.COM to its clients on MARIE-SABOTINE's Internet boutique.
DEFINITIONS
For purposes herein, the following words and expressions shall have following meanings:
- Internet Boutique: shall designate MARIE-SABOTINE's website on which the Products are presented and sold to clients.
- Sales Order: shall designate the sales contract concluded between MARIE-SABOTINE.COM and the client of MARIE-SABOTINE's Internet boutique.
- Product Index Card: shall designate all existing information pertaining to a product furnished by MARIE-SABOTINE.COM at the time said product is marketed on the Internet boutique.
- Products: shall designate all goods sold by MARIE-SABOTINE.COM on its Internet boutique.
- Service(s): shall designate the selling of Products by MARIE-SABOTINE.COM to clients of its Internet boutique.
- Transaction: shall designate all operations, security obligations, authorizations and agreements in connection with payment of the Product(s) ordered.
ARTICLE 1 - SUBJECT MATTER
The purpose of the General Terms contained herein is to define the terms and conditions according to which MARIE-SABOTINE.COM offers and sells Products to its clients. These General Terms shall prevail over any other terms concerning similar or identical sales transactions contained in any other document, unless previously agreed otherwise between the parties in writing.
ARTICLE 2 - ACCEPTANCE OF TERMS
The client acknowledges having read and approved the present General Terms when establishing the Sales Order. Moreover, the client expressly declares to be in full acceptance of said terms. The present General Terms shall govern the contractual relationship between MARIE-SABOTINE.COM and its clients. Both parties fully accept the present General Terms
ARTICLE 3 - PRODUCTS
The majority of the Products offered by MARIE-SABOTINE to its clients are immediately available for sale.
However, if the product is not available, MARIE-SABOTINE.COM undertakes to inform without delay the User
ARTICLE 4 - SALES ORDER
The automatic registration systems are considered as proof of the nature, content and date of the Sales Order.
MARIE-SABOTINE.COM will confirm the client's acceptation of his or her Sales Order by sending a confirmation message to the client's e-mail address (indicated on website). The sale shall be validated upon transmission of the Sales Order confirmation.
MARIE-SABOTINE.COM shall reserve the right to refuse or cancel any client's Sales Order in the event of:
- Client insolvency
- Non-payment by the client for the corresponding Sales Order or any previous Sales Order
- Any contentious matters in connection with payment for previous Sales Order(s)
The client is exclusively responsible for any information that he or she provides when making the Sales Order. MARIE-SABOTINE.COM shall in no way be held responsible for any typing errors made by the client as concerns, notably, the recipient's shipping address and/or the invoicing address etc., thereby causing delays or total hindrance to ship the Product(s).
ARTICLE 5 - SHIPPING
Once the Sales Order has been confirmed, and subject to full payment of the Product(s) ordered by the client, MARIE-SABOTINE.COM will ship the Product(s) to the client or recipient's address under 48H00.
All Products set out in the Sales Order transmitted to MARIE-SABOTINE.COM are strictly reserved for personal use by the client or the recipient explicitly mentioned under the recipient address information. If necessary, the client will ensure that all taxes, rights and/or other shipping charges, including the Products themselves, are paid upon receipt of goods; it being understood that MARIE-SABOTINE.COM shall in no way be held responsible for making said payments.
It is strictly forbidden that the clients or recipients of the Product(s) proceed to resell the Product(s), in part or in full.
The Product(s) will be shipped via LA POSTE (international priority mail or parcel).
Our shipping fees are mentioned on the page Worldwide fast delivery.
Any delays in shipping the Products caused by the shipping company or MARIE-SABOTINE.COM shall not entitle the client or recipient to claim for damages/financial compensation.
When the Product(s) ordered are received by the client or recipient, the latter shall proceed to check the proper functioning of the goods delivered, as well as read over the instructions manual that is furnished with the goods. In the event that on or more of the Products ordered are missing or damages, the client or recipient will dispose of 48 hours to file a claim to the following address: post office.
In the event of serious or obvious damage, the client shall have the right to return the Product(s) according to the procedure set out below.
If the client would like the Products to be shipped to 2 different addresses, then said client shall fill out 2 separate Sales Orders accordingly.
ARTICLE 6 - RIGHT OF WITHDRAWAL
If you wish to return an item which does not suit you and according to the French Law, you have to contact us within a 7-day period from the delivery date.
Marie has decided to extend this period to 10 days.
Enquiries for exchanges or returns made beyond 10 days from the delivery date will be systematically refused.
Any product can be returned except special orders and custom-made items.
According to your choice, we will pay you back or exchange the item for another one of your choice.
In both cases (exchange or return), we recommand you to contact Marie by e-mail at contact@marie-sabotine.com indicating your name and order (or invoice) number. We will send you all the information you need to return your order in the best conditions.
In order to avoid misunderstandings, the buyer will have to ship the item(s) to return exactly as received. We advise you to ship the item(s) via registered letter or parcel with a tracking number. Please keep the receipt mentioning the tracking number and the shipping date.
After checking the perfect condition of the item(s) and according to the French Law, Marie will pay the buyer back (except return shipping fees) within 30 days.
ARTICLE 7 - PRICES
All prices are quoted in Euros.
The price indicated on the Product Index Card does not include shipping fees.
The price indicated in the Sales Order confirmation is the definitive price, including Value Added Tax (VAT) and all other taxes where applicable. The price includes the value of the Products, handling costs, packaging and Product conservation costs as well as shipping and installation costs.
ARTICLE 8 - PAYMENT
The price charged to the customer is the price indicated on the Order confirmation sent by MARIE-SABOTINE.COM.
The Product price is payable by the means of payment offered on website, the day the order is confirmed.
ARTICLE 9 - INTELLECTUAL PROPERTY
All the elements on the web site, visual or sonic, including the underlying technology, are protected by the copyright of the author, the brands or the patents of invention.
They are the exclusive property of MARIE-SABOTINE.COM. The user, visiting the web site MARIE-SABOTINE.COM for personal use, wishing to place a link on his web site, redirecting other users directly to the web site MARIE-SABOTINE.COM, must necessarily ask the company MARIE-SABOTINE.COM for permission. On the other hand, any hyperlink redirecting to the website MARIE-SABOTINE.COM and the use of the Framing technology or the In-line linking technology are formally prohibited.
In any case, any link, even tacitly accepted, needs to be cancelled on simple demand of the company MARIE-SABOTINE.COM. The hyperlinks can redirect to other sites than our web site. MARIE-SABOTINE.COM cannot be held liable if the content of those web sites violates the actual law and rules.
ARTICLE 10 - LEGAL INFORMATION
Given the present e-commerce context, it is obligatory to provide all nominative information in order to ensure the proper registration and shipping of Products, establishment of invoices and contract guarantees. The lack of any necessary information shall result in the failure to validate the Sales Order.
The client has the right to access, modify, amend and/or cancel any information concerning him/her. Moreover, MARIE-SABOTINE.COM shall refrain from releasing any information on its client to third parties, whether free of charge or in exchange of payment.
ARTICLE 11 - APPLICABLE LAW
French Law shall govern the present General Terms, in all aspects.
